The verdict in the Elon Musk-OpenAI case has started a new legal fight. A federal jury in Oakland ruled against Elon Musk in his case against Sam Altman and OpenAI. The case now moves toward an appeal.

The jury reached its decision in less than two hours. Judge Yvonne Gonzalez Rogers accepted the verdict quickly. The court did not study whether Musk’s claims were true and focused only on timing. The jury said Musk filed the OpenAI lawsuit too late under the law.

Musk Plans to Appeal Verdict

Musk strongly disagreed with the decision. He called it a ‘calendar technicality’ in a post. He said the Sam Altman case still raises serious questions. Musk claimed OpenAI leaders moved away from their nonprofit goal and focused on profit.

Musk’s legal team confirmed an appeal. They plan to take the Elon Musk OpenAI verdict to a higher court. Lawyer Marc Toberoff said the case is about protecting charities from misuse. The appeal means the AI nonprofit controversy will continue.

Lawyers for OpenAI and Microsoft welcomed the result. They said the court made a strong legal decision. According to them, the claims came too late and had no legal base under the timing rules.

OpenAI and Microsoft Defend Their Position

Musk filed the OpenAI lawsuit in 2024. He accused the company of breaking its promise to stay nonprofit. He asked for up to $150 billion and wanted leadership changes. He also included Microsoft in the case, claiming it supported the shift to a profit model. The court dismissed all claims against Microsoft.

During the trial, OpenAI gave a different view. Its lawyers said Musk once supported a profit model if he had control. They shared past discussions about linking OpenAI with Tesla. This weakened Musk’s argument in court.
