The US Commodity Futures Trading Commission (CFTC) has proposed a new federal regulatory framework for cryptocurrency exchanges, seeking to bring certain forms of spot crypto trading under a uniform national system. The proposal, announced on Monday (October 5, 2026), focuses on exchanges that allow retail customers to trade digital assets using leverage, margin, or financing. It comes after Congress failed to advance broader cryptocurrency market-structure legislation.

The plan would give eligible exchanges an alternative to the current system, where crypto businesses can face different requirements across individual states. According to the CFTC, a federal framework could provide greater regulatory certainty while introducing additional safeguards for customers and markets.

CFTC Proposes New ‘Crypto Asset Market’ Category

Under the proposal, the CFTC would create a new category of federally regulated trading venues called ‘crypto asset markets’. Exchanges offering leveraged or margined spot crypto products to retail customers could register under this framework and operate under a common set of federal requirements.

The proposed system would cover retail commodity transactions involving crypto assets that fall within the CFTC’s existing statutory authority. However, the agency acknowledged that it does not have the power to require all spot crypto trading to move onto CFTC-registered platforms without action from Congress.

New Requirements for Crypto Exchanges

Platforms opting into the proposed regime would face additional obligations to strengthen market integrity and protect customers. These include anti-market-manipulation controls and proof-of-reserves requirements.

The CFTC is also proposing that customer trades on these federally regulated crypto markets be handled through registered futures commission merchants. The agency said that the framework is intended to establish clearer rules before problems arise rather than relying primarily on enforcement after violations occur.

Proposal Comes Amid Wider US Crypto Regulation Push

The CFTC’s move comes as US regulators continue working toward clearer digital asset rules. Congress recently failed to advance comprehensive crypto legislation, prompting federal agencies to explore how to use existing powers to address regulatory gaps.

CFTC Chair Michael Selig said the proposal aims to give crypto businesses greater certainty while maintaining consumer protections. The agency is now seeking public comments, which must be submitted within 60 days of publication in the Federal Register. Feedback will help determine whether and how the proposed framework moves toward formal rulemaking.
