The US Senate’s market-structure debate has entered a crucial window for XRP, stablecoins, and institutional crypto capital. The House passed the CLARITY Act in July 2025, and the Senate Agriculture Committee advanced its own framework in January 2026. Senate Banking also released bipartisan text in January, leaving lawmakers to decide whether negotiations can become statute as April moves on. 

Senate Tracks Now Need to Converge

Senate Banking signaled momentum early. Chairman Tim Scott released a bipartisan negotiated text on January 12 and scheduled a committee markup for January 15. That work followed committee principles in June 2025, and discussion drafts were released in July and September. 

The Agriculture Committee moved on a separate track. On January 29, it advanced the Digital Commodity Intermediaries Act, which builds on the House-passed CLARITY Act and expands CFTC authority over digital commodities. The House had approved its version by a 294-134 vote on July 17, 2025. 

Can Congress turn those parallel Senate tracks into one bill before the calendar narrows further? Senator Cynthia Lummis later said Republicans aimed for a late-April Banking markup and that the measure must be completed this year. Her reported remarks came after earlier delays tied to stablecoin yield and DeFi language.

XRP and Stablecoins Sit in the Middle

XRP remains central as the Senate’s efforts would place digital commodities under primary CFTC oversight. Franklin Templeton’s XRP ETF filing says the CFTC has determined XRP is a commodity, while Bitwise says the CFTC has asserted commodity status in enforcement actions. Bitwise also says the CFTC regulates XRP futures markets. 

Regulators have also moved. On March 17, the SEC and CFTC issued joint guidance on crypto assets, including digital commodities and stablecoins. Both agencies said the interpretation complements Congress’s effort to codify a broader market-structure framework. 

Stablecoin yield and DeFi rules have slowed Banking Committee progress. Crypto.news reported that Lummis said compromise language on stablecoin yield and DeFi was largely reached, after drafts separated passive yield from activity-based rewards tied to real platform use.

Institutions Keep Watching the Rulebook

Institutional interest remains tied to formal regulation. A 2026 EY-Parthenon and Coinbase survey found that 66% of respondents already hold spot crypto ETFs or ETPs, 81% prefer registered vehicles for spot crypto, and 78% said market structure needs the clearest guardrails. Among firms planning larger holdings, 65% cited improved regulatory clarity as the main driver. 

That backdrop helps explain why XRP’s legislative path draws so much attention. Standard Chartered has said a spot XRP ETF could draw up to $8 billion in first-year inflows, linking clearer rules and ETF access to tangible capital deployment rather than short-term hype. 

Recent fund-flow reports show that XRP has continued to attract money even during uneven macro trading. CoinShares reported XRP inflows of $15.8 million for the week ended March 30 and $19.3 million for the week ended April 13. Those figures kept XRP among the few assets still drawing fresh inflows while broader sentiment shifted. 

The Bigger Picture

The CLARITY Act has the potential to significantly impact XRP, stablecoins, and the adoption of institutional cryptocurrencies. Legal certainty now matters more than short-term price moves. If lawmakers act soon, XRP could move closer to regulated portfolio inclusion and stronger institutional participation.
