A US federal judge blocked the Pentagon from enforcing its decision to blacklist Anthropic, marking a major legal victory for the company behind the Claude chatbot. The order escalated a broader debate over how the US military should use AI.
US District Judge Rita F. Lin ruled on Thursday (August 28, 2026) that the Pentagon’s decision to designate Anthropic as a national security supply-chain risk was unlawful. In her 59-page order, Lin found that the government’s actions amounted to retaliation against the company and violated constitutional protections.
The ruling follows months of tension between Anthropic and the US Defense Department over the military use of Claude. The dispute intensified after Anthropic refused to allow its technology to be used for fully autonomous weapons and mass domestic surveillance. The company argued that its systems should have safeguards around such uses.
In February, Defense Secretary Pete Hegseth designated Anthropic as a supply-chain risk. Such a designation can prevent a company from receiving certain government contracts and restrict its ability to work with federal agencies.
The Pentagon’s move came after negotiations with Anthropic broke down over restrictions the company wanted to maintain around military applications of Claude. The government argued that private technology companies should not be able to limit how the military uses their systems for lawful national security purposes.
The designation was unusual because the supply-chain risk mechanism had generally been associated with concerns about foreign companies and potential threats to military systems. Anthropic became the first US company to be publicly designated.
Anthropic challenged the decision in federal court, arguing that the Pentagon had exceeded its authority and punished the company for its position on the use of its technology. Judge Lin agreed with key parts of that argument. She found that the government's actions constituted unlawful retaliation under the First Amendment and that Anthropic was denied the process required under the Fifth Amendment.
She also concluded that the Pentagon’s decision violated the relevant statutory framework. The judge’s ruling prevents the government from enforcing the measures against Anthropic and sets aside the supply-chain risk designation.

The decision removes a major obstacle for Anthropic as it continues working with government customers. The company had warned that the Pentagon’s action could cost it billions of dollars in business and damage its reputation.
Anthropic welcomed the ruling, saying it remains willing to work with the US government on national-security applications while maintaining its position on safeguards. The Pentagon has not immediately indicated whether it will appeal the decision.
The case could have implications beyond Anthropic. As governments increasingly rely on private technology companies for advanced computing and software, the dispute raises difficult questions about where to draw the line between corporate safeguards, government authority and military requirements.
For the technology industry, the ruling also sends a significant message: national security concerns can carry considerable weight, but they do not automatically grant the government unlimited authority to punish a private company for its policies or public positions.
