A Mobile Shop Owner Receives a Rs. 44,500 Relief Over a 55-Day Delay in Rs. 15 Lakh Prize

A Telangana consumer commission upheld Rs. 44,500 in relief for a mobile shop owner after Kapil Chits delayed his Rs. 15 lakh chit prize payment by more than 55 days.

A Telangana consumer commission has upheld an order directing Kapil Chits to provide Rs. 44,500 in relief to a mobile shop owner after a 55-day delay in releasing his chit prize money.

The case involved S. Eashwar, a mobile shop owner from Mahabubnagar, who won a Rs. 15 lakh prize amount under a Rs. 25 lakh chit. Kapil Chits blamed the delay on the late submission and verification of sureties. However, the commission found that records filed by the company showed an earlier submission date.

Mobile Shop Owner Wins Rs. 15 Lakh Chit Prize

Eashwar joined a Rs. 25 lakh chit run by Kapil Chits in May 2018. Under the scheme, he was required to contribute Rs. 50,000 each month for 50 months. He planned to use the prize money to expand his mobile shop business.

During an auction held on December 15, 2018, Eashwar became the successful bidder after agreeing to forgo Rs. 10 lakh. This left him with a prize amount of Rs. 15 lakh. He later provided four sureties requested by the company, including three income-tax payers and a head nurse employed at a government hospital.

Kapil Chits' Records Raise Doubts Over Surety Claim

Kapil Chits argued that Eashwar submitted his sureties only on April 28, 2019. The company said it needed time to verify the documents before releasing the chit prize money.

However, the Telangana State Consumer Disputes Redressal Commission found a different date in the company's records. A document produced by Kapil Chits showed that Eashwar had furnished the sureties on March 28, 2019.

The record raised doubts over the company's claim that the documents arrived a month later. The commission also noted that the final payment of Rs. 13,00,375 was made on May 25, 2019. Kapil Chits paid a total of Rs. 14,85,000 to Eashwar through three instalments.

Kapil Chits maintained that there had been only a five-day delay after verification. It also said it had paid Rs. 1,100 as interest for that period. However, the commission did not accept that timeline based on the records before it.

Consumer Commission Finds Payment Delayed Over 55 Days

The commission noted that the Chit Funds Act does not set a specific deadline for paying prize money after a subscriber provides the required sureties. However, it found that this did not allow a chit company to keep the payment pending without a reasonable basis.

According to the commission, even if Kapil Chits received seven days to verify the sureties, the company should have completed the payment by early April 2019. The final instalment was instead paid on May 25.

As a result, the commission found that the delay exceeded 55 days and agreed with the District Consumer Commission that the delayed payment amounted to a deficiency in service.

The commission also examined the Rs. 1,100 interest paid by Kapil Chits. It noted that interest on Rs. 15 lakh at 12% annually for about two months would amount to roughly Rs. 30,000. Therefore, it upheld Rs. 25,000 in compensation for the delayed payout.

Kapil Chits Ordered to Provide Rs. 44,500 Relief

A separate dispute involved Rs. 17,500 that Eashwar said Kapil Chits deducted towards an insurance premium without his consent. The company maintained that it later returned the money and submitted documents supporting its position.

The District Consumer Commission had ordered Kapil Chits to refund Rs. 17,500. It also awarded Eashwar Rs. 25,000 as compensation for the delayed chit prize payment and Rs. 2,000 toward litigation costs.

Kapil Chits challenged that decision before the Telangana State Consumer Disputes Redressal Commission. However, the State Commission found no basis to change the lower commission's order.

The three amounts - the Rs. 17,500 refund, Rs. 25,000 compensation and Rs. 2,000 litigation costs - brought the total relief to Rs. 44,500. The Telangana State Consumer Disputes Redressal Commission in Hyderabad passed the order on August 19, 2026.
